nterpretation
In this Ordinance, unless the context otherwise requires--
rge" means any form of security, including a mortgage;

whose activities or objects include the provision of services for

PART II DECLARATION OF CLEARING HOUSES FOR PURPOSES OF THIS ORDI-
NANCE AND RULES OF CLEARING HOUSES
ecognized clearing houses
Where the Commission is satisfied that it is appropriate to do
so in
interest of the investing public or in the public interest, or
for the
er regulation of services for the clearing and
settlement of
sactions in securities, it may, with the consent in writing
of the
ncial Secretary, by notice in the Gazette, declare a clearing
house to
recognized clearing house for the purposes of this Ordinance.
Where the Commission makes a declaration under subsection
(1) in
ect of a clearing house--
it shall give notice thereof in writing to the clearing house;
and
the rules of the clearing house in operation immediately
before the
aration shall continue to have effect unless otherwise
specified, or
l such time as is specified, in the notice referred to in paragraph
ules of recognized clearing houses, etc.
Subject to section 3 (2) (b) and subsection (4), no rules
of a
gnized clearing house (including any default rules of the
clearing
e) or any amendment thereto shall have effect unless
approved in
ing by the Commission.
A recognized clearing house shall have rules which provide
for the
ng of proceedings or other action in the event of a
participant
aring to be unable, or likely to become unable, to

y, and such rules shall comply with the requirements of Schedule
2.
Where a recognized clearing house takes any default proceedings,
all
equent proceedings or other action taken under its rules
for the

defaulter

clearing house notwithstanding that, but for this subsection,
such
equent proceedings or other action would not be treated as done
under
default rules of the clearing house.
The Commission may, by notice in the Gazette, declare any
class of
s of a recognized clearing house (except any default rules

ring house) to be a class of rules which are not required
to be
oved under subsection (1) and, accordingly, any rules of that
clearing
e which belong to that class (including any amendment thereto)
shall
effect notwithstanding that they have not been so approved.
Without prejudice to the operation of subsection (4), a
recognized
ring house shall submit or cause to be submitted to the
Commission,
the information of the Commission, any of its rules
(including any
dment thereto )--
which belong to a class of rules the subject of a declaration
under
ection (4); and
as soon as practicable after those rules (or amendment thereto,
as the
may be) are made.
A recognized clearing house shall submit or cause to be
submitted to
Commission for its approval the rules of the clearing house and
every
dment thereto except any rules (including any amendment thereto)
which
ng to a class of rules the subject of a declaration under

Subject to subsections (8) and (9), the Commission shall,
within 6
s after the receipt of any submission under subsection (6)
from a
gnized clearing house, give notice in writing to the clearing
house

The Commission may, in a particular case, with the agreement of

gnized clearing house concerned, extend the time
prescribed in
ection (7).
The Financial Secretary may, on the advice of the
Commission and
er generally or in a particular case, extend the time
prescribed in
ection (7).
The Commission may request in writing a recognized clearing
house--
to make rules--
specified in the request; and
within the period specified in the request; or
to amend rules--
referred to in the request;
in the manner specified in the request; and
) within the period specified in the request.
Where the Commission is satisfied that a recognized clearing
house
not complied with a request referred to in subsection (10) within
the
od specified in the request, the Commission may direct in writing
the
ring house to comply with the request within such further period
as is
ified in the direction and, accordingly, the clearing house
shall

For the purposes of subsection (10), "rules", in relation

None of the following shall be regarded as to any extent
invalid at

settlement of

a market charge;
the default rules of a recognized clearing house; or
any default proceedings.
Subject to subsection (3), the powers of a relevant office-
holder in
capacity as such, and the powers of a court under the
law of
lvency, shall not be exercised in such a way as to
prevent or
rfere with--
the settlement in accordance with the rules of a recognized
clearing
e of a market contract; or
any default proceedings.
Subsection (2) shall not operate to prevent a relevant
office-holder
seeking to recover any amount under section 11 after the

A recognized clearing house shall, upon the completion by it of

ult proceedings, make a report on such proceedings stating in

the net sum, if any, certified by the clearing house to be payable

r particulars in respect of such proceedings as it thinks fit.
A recognized clearing house which has made a report
pursuant to
ection (1) shall supply the report to--
the Commission;
any relevant office-holder acting in relation to--
the defaulter to whom the report relates; or
that defaulter's estate;
if there is no relevant office-holder referred to in paragraph
(b),
defaulter to whom the report relates.
Where the Commission receives pursuant to subsection (2) a report
made
uant to subsection (1), it may publish notice of that fact in
such
er as it thinks appropriate to bring it to the attention of
creditors
he defaulter to whom the report relates.
Where a relevant office-holder or defaulter receives
pursuant to
ection (2) a report made pursuant to subsection (1), he shall,
at the
est of a creditor of the defaulter to whom the report relates--
make the report available for inspection by the creditor;
on payment of such reasonable fee as the relevant office-
holder or
ulter, as the case may be, determines, supply to the creditor all
or
part of that report.
In subsections (2), (3) and (4), "report" includes a copy of a
report.

The provisions of this section shall apply with respect to any
net sum
ified under section 7 (1) (a) by a recognized clearing house, upon

Where a receiving or winding-up order has been made, or a

Neither section 42 of the Bankruptcy Ordinance (Cap. 6) nor

of the Companies Ordinance (Cap. 32) shall apply in relation to
any
matter or thing which has been done pursuant to--
a market contract;
a disposition of property pursuant to a market contract;
the provision of market collateral;
a contract effected by a recognized clearing house for the purpose
of
izing property provided as market collateral, or any
disposition of
erty pursuant to such a contract;
a disposition of property in accordance with the rules of a
recognized
ring house as to the application of property provided as
market
ateral;

关于印发自治州城镇物业管理实施细则(试行)的通知
各县市人民政府,州人民政府各部门、各直属单位:
《自治州城镇物业管理实施细则(试行)》已经州人民政府同意,
现印发你们,请认真贯彻执行。

自治州城镇物业管理实施细则(试行)
第一章 基本原则
第一条 为规范物业管理活动,维护业主、物业使用人和物业管
理企业的合法权益,保障物业的有效管理、服务和使用,营造良好的
居住生活环境,根据国务院《物业管理条例》及有关法律、法规规定,
结合我州实际,制定本细则。
第二条 在自治州各县市城镇区域内从事物业管理和对物业管理
的监督管理,适用本细则。
实施物业管理的住宅小区(项目),配套设施应完善、齐全。新
建住宅小区(项目)和配套设施比较齐全的原有住宅小区(项目)应
实行物业管理。配套设施不完善的原有住宅小区(项目),如水、电、
供暖、天然气、物管用房、垃圾箱、自行车棚等建设不到位以及地下
相关管线严重老化的,由原开发建设(产权)单位及相关供应单位整
治完善,经验收合格后实行物业管理。
第三条 实施物业管理应逐步实行招投标方式,以公开、公平、公
正的原则,选聘具有相应资质的物业管理企业进行管理。
第四条 物业管理实行专业化、社会化和市场化运作机制。一个物
业管理区域只能成立一个业主大会。
物业管理区域的划分由各县市房地产行政主管部门在充分考虑物
业的共用设施设备使用、建筑规模、社区建设等因素自行确定。
第五条 各县市房地产行政主管部门是本行政区域物业管理的行政
主管部门,具体负责本行政区域物业管理活动的监督管理工作。
各县市规划、物价、园林、民政、公安、邮政、电信、供电、有
线电视、市政、环卫、供水、供暖、供气等部门和单位,按照职责分
工,做好与物业管理有关的管理工作。
街道办事处(居委会)按照国家、自治区和本细则规定,做好物
业管理活动中的协调和指导工作。
物业管理企业按照物业管理法律、法规的规定和物业服务合同的
约定,实施物业管理。业主应自觉遵守业主公约的约定,支持配合物
业管理企业对住宅小区实施有效管理。
第二章 业主及业主大会
第六条 业主是指房屋的所有权人。
业主大会由物业管理区域内全体业主组成。对于业主人数较少的
物业管理住宅小区,经全体业主一致同意,决定不成立业主大会的,
由业主共同履行业主大会、业主委员会职责。
新建住宅小区(项目)交付使用,入住率达到50%以上的,应召开
首次业主大会,选举产生业主委员会。
第七条 物业小区(项目)内成立业主大会的,应在物业所在地县
市房地产行政主管部门和街道办事处(居委会)指导下成立业主大会
筹备组,筹备组负责召开首次业主大会。筹备组成员由业主代表、街
道办事处(居委会)、建设单位(包括公有住房出售单位)及公安派
出所人员组成。筹备组成员名单确定后,以书面形式在物业管理区域
内公示。
第八条 筹备组应做好下列筹备工作:
(一)确定首次业主大会会议召开的时间、地点、形式和内容;
(二)参照政府主管部门制订的示范文本,拟定《业主大会议事规
则》(草案)和《业主公约》(草案);
(三)确认业主身份,拟定业主在首次业主大会会议上的投票权数;
(四)拟定业主委员会委员候选人产生办法及名单;
(五)做好召开首次业主大会会议的其他准备工作。
前款(一)、(二)、(三)、(四)项的内容应在首次业主大
会会议召开15日前以书面形式在物业管理区域内公示。
第九条 业主大会议事规则应就业主大会的议事方式、表决程序、
业主投票权确定办法、业主委员会的组成和委员任期等事项做出规定。
第十条 业主公约应就物业的使用、维护、管理,业主的共同利益、
业主应履行的义务、违反公约应承担的责任等事项做出约定;业主公约
对全体业主具有约束力。
第十一条 业主大会会议可分为定期会议和临时会议。
业主大会定期会议应按照业主大会议事规则的规定由业主委员会
组织召开。
有下列情况之一的,业主委员会应及时组织召开业主大会临时会
议:
(一)20%以上业主提议;
(二)发生重大事故或者突发紧急事件需要及时处理的;
(三)业主大会议事规则或者业主公约规定的其他情况;
发生上述情况之一的,业主委员会如不履行组织召开会议职责的,
各县市房地产行政主管部门应责令业主委员会限期召开。
第十二条 业主大会会议可以采用集体讨论的形式,也可以采用书
面征求意见的形式。 但应有物业管理区域内持有1/2以上投票权的业
主参加。
业主因故不能参加业主大会会议的,可以书面委托代理人参加。
第十三条 物业管理区域内业主人数较多的,可以栋、单元、楼层
为单位,推选一名业主代表参加业主大会会议。
推选业主代表参加业主大会会议的,业主代表应于参加业主大会
会议3日前,就业主大会会议拟讨论的事项书面征求其所代表的业主意
见,凡需投票表决的,业主的赞同、反对及弃权的具体票数经本人签
字后,由业主代表在业主大会投票时如实反映。
第十四条 业主委员会应在业主大会会议召开15日前将会议通知
及有关材料以书面形式在物业管理区域内公告。
住宅小区召开业主大会会议,应同时告知所在地的街道办事处(居
委会)。
第十五条 业主大会做出决定,必需经与会业主所持投票权1/2以
上通过。
业主大会做出制定和修改业主公约、业主大会议事规则、选聘、
解聘物业管理企业、专项维修资金使用、续筹方案等重大决定,必需
经物业管理区域内全体业主所持投票权2/3以上通过。
业主大会做出的决定对物业管理区域内的全体业主具有约束力。
业主大会做出的决定应以书面形式在物业管理区域内及时公告。
第十六条 业主委员会委员必须是在本小区居住的业主。
业主委员会应自选举产生之日起30日内,将业主大会的成立情况、
业主大会议事规则、业主公约及业主委员会委员名单等材料向物业所
在地县市房地产行政主管部门备案。
业主委员会备案的有关事项发生变更的,依照前款规定重新备案。
第十七条 业主委员会履行以下职责:
(一)召开业主大会会议,报告物业管理的实施情况;
(二)代表业主与业主大会选聘的物业管理企业签订物业服务合同;
(三)及时了解业主、物业使用人的意见和建议,监督和协助物业
管理企业履行物业服务合同;
(四)监督业主公约的实施;
(五)不得在本物业小区从事经营活动;
(六)业主大会赋予的其他职责。
第十八条 业主委员会应督促违反物业服务合同约定逾期不缴纳物
业服务费用的业主,限期交纳物业服务费用。
第十九条 业主大会和业主委员会开展工作的经费由全体业主承担;
经费的筹集、管理、使用具体由业主大会议事规则规定。
业主大会和业主委员会经费的使用情况应定期以书面形式在物业
管理区域内公告,接受业主的质询。
第二十条 业主委员会委员由五人以上单数组成,任期三年,可连
选连任。任职期间发生变动,应及时进行补选。任期届满2个月前,应
召开业主大会会议进行业主委员会的换届选举;逾期未换届的,物业
所在地县市房地产行政主管部门和街道办事处(居委会)应指派人员
指导其换届工作。
原业主委员会应在其任期届满新的业主委员会成立之日起10日内,
将其保管的档案资料、印章及其他属于业主大会所有的财物移交新一
届业主委员会,并做好交接手续。
第二十一条 业主大会、业主委员会应依法履行职责,不得做出与
物业管理无关的决定,不得从事与物业管理无关的活动。
物业小区(项目)的业主大会、业主委员会做出的决定,应告知
相关的居委会,并听取居委会的建议。
业主大会、业主委员会做出的决定违反法律、法规的,物业所在
地的县市房地产行政主管部门应责令限期改正或者撤销其决定,并通
告全体业主。
第二十二条 业主大会、业主委员会应配合公安机关、街道办事处
(居委会)等单位,共同做好维护物业管理区域内的公共秩序等相关工
作。
在物业管理区域内,业主大会、业主委员会应积极配合所在居委会
依法履行自治管理职责,支持居委会工作,并接受其指导和监督。
第二十三条 业主大会和业主委员会的印章依照有关法律、法规、
规章和业主大会议事规则的规定刻制、使用、管理。
违反印章使用规定,造成经济损失或者不良影响的,由责任人承
担相应的责任。
第三章 前期物业管理
第二十四条 建设单位按照房地产开发与物业管理相分离的原则,
通过招投标的方式选聘具有相应资质的物业管理企业实施前期物业管
理。
物业小区的建设单位招投标选聘物业管理企业;投标单位少于3个
或者住宅规模较小的,经物业所在地的县市房地产行政主管部门批准,
可以采用协议方式选聘具有相应资质的物业管理企业。
第二十五条 建设单位选聘物业管理企业,应签订书面的前期物业
服务合同。前期物业服务合同应包括服务内容、服务标准、收费项目、
收费标准、计费方式和起止时间等内容。
建设单位与物业买受人签订的物业销售合同,应包含前期物业服
务合同约定的内容。
第二十六条 前期物业服务合同可以约定期限,最长不得超过二年
(分期建设的物业除外)。
前期物业服务合同期限未满,已成立业主大会并选聘新的物业管
理企业的,前期物业服务合同终止。
前期物业服务合同期限已满,尚未成立业主大会或者业主大会已
成立但尚未选聘新的物业管理企业的,物业管理企业可以按照前期物
业服务合同的约定,继续从事物业管理服务,直至业主大会选聘新的物
业管理企业之日起终止。但业主大会要求物业管理企业退出的,物业
管理企业应退出。
前期物业服务合同期满不再继续从事物业管理服务的,物业管理
企业应于期满前二个月通知业主。
第二十七条 建设单位应在销售物业之前,参照国家示范文本制定
业主临时公约,并向物业买受人明示。
物业买受人在与建设单位签订物业销售合同时,应书面承诺遵守
业主临时公约。
第二十八条 建设单位在进行小区(项目)规划建设时,应配套
建设必要的物业管理用房(含办公室、警卫室、清洁储藏室、业主委
员会活动用房)。建筑面积5万平方米以内的物业小区(项目)不少
于80 平方米,5万平方米以上的物业小区(项目)按总建筑面积的2‰
提供。
第二十九条 物业管理用房属全体业主所有。物业管理企业应将
物业管理用房的有关情况在物业管理区域内公示,并负责维护和管理。
物业管理用房不得抵押、交换、买卖;未经业主大会同意,不得改作
他用。
第三十条 前期物业服务合同生效之日至出售房屋交付之日的当
月发生的物业服务费用,由建设单位承担。
出售房屋交付之日的次月至前期物业服务合同终止之日的当月发
生的物业服务费用,由物业买受人按照物业销售合同约定的前期物业
服务收费标准承担;物业销售合同未约定的,由建设单位承担。
第四章 物业管理服务
第三十一条 从事物业管理活动的企业应具有独立的法人资格,
国家对从事物业管理活动的企业实行资质管理。
从事物业管理服务的从业人员,按照国家有关规定取得职业资格
证书。
物业管理行政管理部门应建立物业管理企业信用档案,向社会公
开。
第三十二条 一个物业管理区域由一个物业管理企业实施物业服务。
物业管理企业的选聘、续聘、解聘由业主委员会组织召开业主大会决
定。
业主委员会应根据业主大会的授权与业主大会选聘的物业管理企
业签订书面物业服务合同。
物业服务合同草案应在物业管理区域内公示,充分听取业主意见。
第三十三条 物业管理企业可以将物业管理区域内的专项服务业务
委托给专业性服务企业,但不得将该区域内的全部物业管理一并委托给
他人。
第三十四条 物业管理企业应按照自治区《普通住宅物业管理服务
等级标准》和物业服务合同的约定,向业主提供相应的服务。
第三十五条 物业服务收费应遵循合理、公开以及费用与服务水平
相适应的原则,区别不同物业的性质和特点,实行政府指导价和市场调
节价。 收费标准由业主和物业管理企业按照价格主管部门会同建设行
政主管部门制定的物业服务收费办法,在物业服务合同中约定。
第三十六条 物业管理区域内供水、供电、供气、供热、通讯、有
线电视等单位应向最终用户收取有关费用。 最终用户是指接受供水、
供电、供气、供热、通讯、有线电视等服务的最终分户使用人。 业主
自用的向业主收取;物业管理企业使用的向物业管理企业收取;公共使
用的由业主分摊,按合同约定收取。
前款所列单位不得利用特种垄断经营优势的便利,强制物业管理企
业代收费用,也不得因物业管理企业拒绝代收有关费用而停止提供服务。
物业管理企业接受委托代收费用的,双方应签订代收服务合同,但
不得向业主收取手续费等额外费用。
第三十七条 业主应根据物业服务合同的约定交纳物业服务费用。
业主与物业使用人约定由物业使用人交纳物业服务费用的,从其约定,
业主负连带交纳责任。
已竣工但尚未出售或者尚未交给物业买受人的物业,物业服务费
用由建设单位交纳。
第三十八条 县市人民政府价格主管部门会同同级房地产行政主
管部门,应加强对物业服务收费的监督。
第三十九条 物业管理企业应协助相关部门做好物业管理区域内的
安全防范工作,创建平安小区。
物业管理企业雇请保安人员的,应遵守国家有关规定。保安人员在
维护物业管理区域内的公共秩序时,应履行职责,不得侵害公民的合法
权益。
物业管理企业应积极创造条件,采用电子监控等手段加强防范,
提高管理水平,维护住宅小区的安全。
第四十条 对物业管理区域内违反有关治安、环保、物业装饰装修
和使用等方面法律、法规、规定的行为或发生安全事故时,物业管理企
业应制止或在采取应急措施的同时,及时向有关行政管理部门报告,
并协助做好救助工作。
有关行政管理部门在接到物业管理企业的报告后,应及时依法对
违法行为予以制止或者依法处理。
第五章 物业的使用和维护
第四十一条 物业管理区域内按照规划建设的公共建筑、共用设
施和公共绿地,不得改变用途和私自占用。
业主依法确需改变公共建筑和共用设施用途的,应在依法办理有
关手续后告知物业管理企业;物业管理企业确需改变公共建筑和共用
设施用途的,应提请业主大会讨论决定同意后,由业主委员会依法办
理有关手续。
第四十二条 物业管理小区内的公共停车场(位),停放车辆需要
收费的,由业主大会决定。业主大会决定对停放车辆收费的,可委托
物业管理企业依照物价部门制定的标准收取。其收入扣除成本外,用
于弥补维修资金的不足。
车主对车辆有看管要求的,由车主和物业管理企业依照物价部门
制定的标准另行签订看管合同。
公安、消防、抢险、救护、环卫等特种车辆执行公务时在物业管
理小区内停放,不得收费。
小区内停放车辆不得影响其他车辆和行人的正常通行。
第四十三条 业主、物业管理企业不得擅自占用、挖掘物业管理
区域内的道路、场地,损害业主的共同利益。
因维修物业或者公共利益,业主确需临时占用、挖掘道路、场地
的,应征得业主委员会和物业管理企业的同意;物业管理企业确需临
时占用、挖掘道路、场地的,应征得业主委员会的同意。
业主、物业管理企业应将临时占用、挖掘的道路、场地,在约定
期限内恢复原状。
第四十四条 供水、供电、供气、供热、通讯、有线电视等单位,
应依法承担物业管理区域内相关管线和设施设备的维修、养护责任。
责任划分如下:
(一)供水、供热设施:住宅楼单元门前检修井以内部分由业主负
责,以外部分由供水、供热单位负责。
(二)排水设施:住宅区建设红线范围内的排水管道及窨井(不含
市政管线)由业主负责;以外的由市政部门负责。
(三)供气设施:由供气部门负责,维修、更新改造费用按有关规
定执行。
(四)供电设施:住宅楼用户电表以内(含电表)由业主负责,电表
以外由供电部门负责管理。
(五)通讯设施:由通讯部门负责。
(六)有线电视设施;由有线电视部门负责。
由业主负责的房屋共用部位和共用设施设备部分,可以委托物业
管理企业实施维修养护。业主房屋室内自用部分,由业主自行维修;
上述单位因维修、养护等需要,临时占用、挖掘道路、场地的,
应服从物业管理企业的管理和监督。工程完工后应及时恢复原状。造
成损失的,应给予相应赔偿。
第四十五条 物业使用禁止下列行为:
(一)损坏房屋承重结构;
(二)损坏或者擅自占用物业共用部位、共用设施设备,移动共用
设施设备;
(三)擅自改变物业的使用性质,私搭乱建;
(四)侵占绿地、毁坏绿化;
(五)随意堆放、倾倒或者抛弃垃圾、杂物;
(六)违反规定生产、储存、经营易燃、易爆、毒害性、放射性物
品,排放有毒、有害物质或者产生超过规定标准的噪声;
(七)未经批准摆摊设点;
(八)随意停放车辆;
(九)在建筑物或者构筑物上乱悬挂、乱张贴、乱涂写、乱刻画;
(十)利用房屋从事危害公共利益或者侵害他人正当权益的活动;
(十一)将不具备居住条件的住宅楼地下室用于居住;
(十二)在消防通道上设置路障,损坏或者挪用消防设施;
(十三)法律、法规、规章和业主公约禁止的其他行为。
第四十六条 业主或者使用人装饰装修房屋,应事先告知物业管
理企业,物业管理企业应将房屋装饰装修中的禁止行为和注意事项以
及违反规定的处理办法书面告知业主或者使用人。装修人不得拒绝和
阻碍物业管理单位对装饰装修活动的监督检查。
第四十七条 业主房屋在使用中向邻居房屋漏水的,由该业主负责
查明原因,属保修期内工程质量问题的,由建设单位负责维修,超过
保修期的或业主装修及使用不当造成的,由该业主负责维修,邻居业
主要积极配合维修工作。该业主不进行维修或邻居业主不配合维修的,
承担由此造成的一切损失。
第四十八条 房屋共用部位和共用设施设备部分,由物业管理企业
根据合同的约定定期进行维修养护。
物业管理企业对物业共用部位、共用设施设备进行维修养护时,
相关业主和使用人应给予配合。因阻挠维修养护造成物业损坏或财产
损失的,责任人应负责修复或者赔偿。
第四十九条 住宅小区内的住宅物业、非住宅物业,应按照国家
有关规定交纳专项维修资金。
专项维修资金属业主所有,专项用于物业保修期满后物业共用部
位、共用设施设备的维修和更新、改造,不得挪作他用。
专项维修资金收取、使用、管理的办法由县、市房地产行政主管
部门会同财政部门制定。
第六章 附 则
第五十条 本细则自公布之日起施行。
